How the size is measured

generating capacity: the nameplate rating of the generator, and where the generator is direct current it is measured on the alternating current ratings of the proposed inverters. For photovoltaic this is the inverter AC rating, and it sets both the review level and the insurance band.

Size bands and what each one obliges

Level 1 Size 0 to 25 kW

An inverter based generator not greater than 25 kW. The application fee is $100 and a cost sharing fee of $150 is due when the executed agreement is returned. The customer is responsible for distribution upgrade costs above $5,000. No insurance is required for an inverter based facility of 1 MW or less.

Level 2 Size 25.001 to 2000 kW

A generator not greater than 2 MW. The fee is $100 plus $2 per kW of generator capacity. For an on site load facility above 25 kW to 250 kW the cost sharing fee is $25 per kW and the customer carries distribution upgrade costs above $10,000.

Level 4 Size 2000.001 kW and above

All generators not subject to federal jurisdiction that do not fit a lower level. The fee is $3,000 plus charges for actual study time, and a further $500 for changes to the application after notice of completeness. Insurance for an inverter based facility is $1,000,000 above 1 MW to 5 MW and $2,000,000 above 5 MW.

The screens that decide it

Ask the utility this, before you sell it

  1. What is the line section minimum load and minimum daytime load, and what percentage of it would this facility represent? Maine requires the utility to disclose all three on a screen failure where available, which is a better starting point than most states give.
  2. What is the export capacity of this design as you will record it? Maine measures the screens on export capacity and the insurance and review level on generating capacity, so an export limited system is measured two different ways at once.
  3. Is this address served by a consumer owned utility or a cooperative? Unlike most states these rules reach them, because the definition turns on operating a transmission and distribution plant rather than on ownership.

Worth knowing before you quote

Maine bars a utility from requiring an applicant to install additional controls including a utility accessible disconnect switch, to perform or pay for additional tests, or to buy additional liability insurance beyond the published table. That disconnect prohibition is a direct contrast with Wyoming and Arkansas, which mandate one. Level 3 is the non export track for generators not greater than 10 MW and is not a size band, with a fee of $100 plus $3 per kW. There is a dedicated energy storage section requiring a standard form describing the configuration, and a dedicated export control section listing the acceptable methods. Timelines run in business days: five to completeness, ten to screen results, ten for an additional review estimate, forty five for an impact study or thirty where a feasibility study was done, and ten to issue an agreement. No aggregate cap appears in the chapter.

Read and recorded 2026-09-12. The applicability definition is entity neutral: a transmission and distribution utility is anyone owning, controlling, operating or managing a transmission and distribution plant for compensation in the state. It turns on operating the plant rather than on ownership form, so Maine consumer owned utilities and cooperatives are reached, unlike most states. Net energy billing sits in a separate chapter that was not read, so its size and consumption limits are unknown.
